A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new article, designated §21-16-1, relating to prohibiting convicted felons from holding employment positions that provide them with access to medical, financial or other confidential information of clients or patients of the employer; and authorizing rule-making.
Be it enacted by the Legislature of West Virginia:
     That the Code of West Virginia, 1931, as amended, be amended by adding thereto a new article, designated §21-16-1, to read as follows:
ARTICLE 16. EMPLOYMENT OF CONVICTED FELONS.
§21-16-1. Employment of felons prohibited; rule-making.
__________(a) An employer, as that term is defined by section two, article one-a of this chapter, is prohibited from employing convicted felons who have, or might have, access to financial, medical or other confidential information relating to patients or clients of that employer.
__________(b) A person, as that term is defined by section two, article one-a of this chapter, who is a convicted felon is prohibited from holding employment in a position that gives, or might give, him or her access to financial, medical or other confidential information relating to patients or clients of his or her employer.
__________(c) The Commissioner of Labor is authorized to propose rules for legislative approval in accordance with article three, chapter twenty-nine-a of this code necessary to effectuate this section.

__________NOTE: The purpose of this bill is to prohibit convicted felons from holding employment positions that provide them with access to medical, financial or other confidential information of clients or patients of the employer. The bill authorizes rule-making.
